Attorney Rebecca Rogers Appellate Cases

The following are some examples of the clients Attorney Rogers has helped with appeals in the state and federal courts.

Appeal to the Massachusetts Supreme Judicial Court

Attorney Rogers was a key member of the appellate team that represented a client injured by a generic drug.  Under existing law at the time, generic drug manufacturers could not be held liable for inadequate warnings.  At the same time, in most states courts would not hold the brand name manufacturer liable, even though they are responsible for the label.

Our client's case was initially dismissed in the trial court for this reason.  Rebecca and the slnlaw team prepared an exhaustive appeal, arguing that traditional principles of tort law required that the companies responsible for the label should be held responsible for failing to warn of serious side effects.

The Massachusetts Supreme Judicial Court agreed, and issued a decision changing the law in Massachusetts and providing protection for generic drug consumers.  Attorney Rogers' work on the research and drafting of the appeal was a major reason for this result.

Employee Shareholder Appeal

Attorney Rogers served as the appellate specialist for an slnlaw client who was an employee and minority shareholder of a privately held investment management company.  Rebecca researched and drafted the appeal brief, which tackled novel and complex issues about the scope of fiduciary duty under Massachusetts law.  The case eventually settled.

Defending a Civil Judgment on Appeal

Rebecca was the primary attorney defending a civil judgment for a fishing boat operator claiming money due under an employment contract and a business contract.  She successfully defended the judgment, securing a substantial benefit for the client.
