The Role of an Attorney in the Massachusetts Probate Process
Your First Decision in Probate: With or Without a Lawyer? It is possible to navigate the Massachusetts probate court system without an attorney. There are also state-provided resources to help guide you through the process if you decide to represent yourself.
What is important to consider, however, is that whether you have an attorney or not the court will require you to follow all the steps correctly, some of which can be confusing. Mistakes can cause delay in a process that is already longer than most people wish. It is also important to remember that many of the decisions you will have to make during the probate process can have legal and tax implications for the heirs, and may require some specialized understanding of the estate as a whole to navigate most effectively.
