Attorney Elijah Bresley Employment Law Cases

The following are some examples of the clients Attorney Bresley has helped to resolve cases arising from employment discrimination and wage and hour violations.

Employment Discrimination and Retaliation Cases

Attorney Bresley has successfully represented clients before the Massachusetts Commissino Against Discrimination ("MCAD"), in court, and in pre-litigation severance negotiations who have experienced discrimination.  These matters include:
  • A client with one arm who was denied a job because he could not perform certain tasks "with both hands."
  • A 27 year employee at a health care institution fired after taking medical leave.
  • A healthcare worker fired after reporting patient abuse.
  • A restaurant employee fired after reporting sexual harassment to her managers.
  • A client terminated after reporting a workplace injury.

Wage and Hour Cases

Attorney Bresley has also helped numerous clients with unpaid wages, unpaid overtime, and improper classification issues.  Some of the matters he has resolved for clients include:
  • An insurance employee improperly classified as an independent contractor who was never paid her final commissions.
  • A worker owed overtime who was terminated after he asked for the overtime pay.
  • A commissioned sales employee who was terminated and not paid substantial commissions.
  • Multiple clients not paid their final paycheck and/or vacation time after termination.

"Long overdue public words of gratitude for Emily and her associates' work on my behalf. They were so very respectful of me during an emotionally and financially ridden time -- and that mattered more than the positive result. May all clients have such advocates on their sides!" Donna B.

Attorney Bresley has also helped clients understand their non-compete agreements, and assess the risks of enforcement, defended small employers in employee lawsuits claiming discrimination and non-payment of wages, and advised small business owners on proactive employment law matters.
