How to Evaluate a Severance Agreement?

The obvious question in evaluating a severance package is whether what is being offered is more or less valuable than any claims you might have against the employer.  This is because the fundamental exchange is money for a release of those claims.
  • Even if you believe you have legal claims, there are other considerations as well.  For example:
  • Does the agreement impose more restrictions (i.e., a non compete or non disparagement) than you currently have?
  • Is the payment "no strings attached," or do payments stop if you get a new job?
  • Does the agreement also provide for continued health benefits?
  • Does the agreement put you at risk in any way- for example, putting you on the hook for paying damages if there is a violation of a non disparagement clause?
