When is a sales commission legally earned? If your company has a written commission plan that specifies when a commission is earned, in most cases this will control. If your commission policy does not specify this, the commission will most likely be considered "earned" as soon as a sale is made. Do commission-based employees need to be paid minimum wage? It depends. Some employees solely receive straight commissions with no base salary or guaranteed draw against commissions. In such cases, their earnings may fluctuate from week to week or month to month. Employers should ensure that their weekly earnings meet or exceed the minimum wage for the hours worked.
