Attorney Jenna Ordway Estate Planning Matters

The following are some examples of the clients Attorney Ordway has helped to create the estate planning documents they need to achieve their goals.

Estate Planning Clients With Young Children

Attorney Ordway has worked with many families with young children to create a basic estate plan.  For the most part, these clients are primarily concerned about what will happen to their children if they were both to pass.  Attorney Ordway takes care of this by designating guardians in the will, and in most cases drafting a trust to receive assets for the children.

What many of these families don't always realize is that they have more than they think in terms of assets.  Jenna and the rest of the estate planning team work with them to identify all assets, decide whether planning for tax purposes is necessary,

Estate Planning Clients With Blended Families

Many of Jenna's clients have one or more spouse with children from a prior relationship or marriage.  Several have come in for estate planning when they are expecting their first child together. 

These families also need a plan for guardianship of minor children.  In addition, they have important decisions to make about how the parents' assets are distributed among all of the children, and whether they need trusts to manage assets for children of the marriage and not of the marriage.

Attorney Ordway and the estate planning team take time with these clients to understand their wishes and draft the documents they need to achieve their goals, whatever those goals may be.

Estate Planning Clients Who Are Not United States Citizens

Attorney Ordway has also helped estate planning clients where one or both spouses are not United States Citizens.  In many ways their estate planning needs are the same as anyone else's, but there are different rules regarding estate tax thresholds that need to be considered if either spouse is a foreign national.

She has helped these families identify the documents they need to protect assets from estate tax and ensure that the immigration status does not get in the way of achieving their goals.

Estate Planning for Aging Parents

Jenna has also worked with numerous clients who are trying to help their own aging parents get a plan in place while they still can.

In this case the client we represent is the aging parent, but the adult children are an invaluable resource in making sure the client's questions are answered and the plan we are making accomplishes what they want.

Among the things Attorney Ordway helps aging clients with is determining whether to make a plan to protect assets from the costs of long term care.  These can be delicate and difficult conversations, but she and the team have a lot of experience making it as painless as possible to discuss these issues.

Same Sex Estate Planning Clients

Attorney Ordway has worked with same sex couples, both married and unmarried, to create appropriate and comprehensive estate plans.

If the couple is married, the same rules apply as to any married couple.  There is sometimes an increased risk that extended family will challenge the estate planning documents, however.  This is of particular concern when it comes to health care proxies, as an extended family who does not recognize the marriage may seek to intervene if their relative is incapacitated.  This requires careful planning and a frank discussion about each spouse's family situation.

If the couple is not married, they are missing out on many protections under the law, but can still ensure their assets pass the way they want, and the people they want serve as health care proxy and power of attorney, with the right estate planning documents.
