Employment Law Solutions

  • Employment Discrimination
  • Wage and Hour Violations
  • Sexual Harassment
  • Non Compete Agreements
  • Independent Contractors
  • Job Termination and Severance
Employment discrimination  is unlawful.  If you believe you were singled out based on race, gender, disability, or other protected class, we can help you understand whether you have a legal claim and pursue compensation if you do.
It is illegal under Massachusetts wage and hour laws for an employer to withhold wages or commissions, or overtime pay for eligible employees.  We can help you get what you are owed, or ensure your business is not at risk due for a wage and hour lawsuit.
You have a right to be free from sexual harassment at work.  If you report harassment, your employer has a duty to investigate fairly and not to retaliate against you.  We can help if you believe these rights have been violated.
We can help you make an informed decision about signing a new non compete agreement, understand your rights under an existing agreement, and defend you if your employer tries to enforce your non compete agreement.
If you are working as an independent contractor, you may be missing  important benefits and protections the law gives to employees.  Contact us to find out if you have been misclassified and how you can make it right.
Losing a job is hard.  Not understanding why or whether your termination was lawful can also be hard.  We can help you assess your situation, identify potential legal claims, and/or negotiate a better severance package.

Estate Planning Solutions

  • Make a Plan for Your Children
  • Save Your Assets for Your Family
  • Prepare for Long Term Care
  • Clarify Medical Decision Making
  • Take Care of Business
  • Keep Your Family Out of Court
We know worst case scenarios are unlikely to happen, but it's our job to plan for them anyway.  Even a simple estate plan can ensure that your minor children have guardians and funds in case something happens to both parents.
In Massachusetts, it is easier to find yourself owing estate tax than you might think.  Even when you don't think you're rich. We can help you put a plan in place that saves as much of your hard-earned legacy as possible for your loved ones.
If you or your spouse need long term care/assisted living, you can quickly wipe out all you have worked so hard to build to pay for it.  We can help you create an asset protection trust to help you qualify for assistance and preserve assets.
If you are too sick to make decisions, it is critical to have someone you trust to make  decisions for you.  We can help with a health care proxy to make sure your doctors have clear guidance and your wishes are honored.
Your business and financial affairs matter as well if you are too sick to make decisions.  We can help with a Power of Attorney to give someone you trust the legal right to take care of your financial and business decisions.
Without an estate plan, your family could spend a year or more in court (and money on lawyers) to settle your estate.  A comprehensive plan can minimize or avoid altogether the need for your family to hire lawyers and go to court.

If you do not have solid contracts in place in your business, you may find yourself in litigation if something goes wrong.  We create clear and understandable contracts to make sure your interests are protected.
Massachusetts law strictly limits who can be considered a contractor, and the cost of getting it wrong can be much higher than putting them on payroll.  We can help make sure you get this right.
The last thing you need is an expensive employee lawsuit.  The truth is most of these suits come from common mistakes that are easily avoided.  We  help steer you away from those traps before they become a problem.
If you have to let someone go, an ounce of prevention is worth at least a pound of cure.  We provide a roadmap for the termination process that steers you away from common legal mistakes and manages any risk you may have.
Defending a lawsuit was not part of your plan, but sometimes it happens.  When it does, you want someone in your corner who will not only defend you but make it a priority to get to resolution as quickly as possible.

MESSAGE FROM THE FOUNDER

Emily Smith-Lee Massachusetts Lawyer
"When I started this practice in 2009, I thought I knew all about being a lawyer.  I had spent thirteen years at a prestigious international law firm in Boston.  I had worked on complex cases involving large companies in many industries, from pharmaceutical to health care to seed companies.  What I did not understand then was the true power of being in a position to help ordinary people facing challenges that seem extraordinary to them.  I have had the opportunity to help families make sure the people they love the most are protected, small businesses avoid catastrophic lawsuits, entrepreneurs launch their dream without exposing their families to liability, hardworking people protect their right to be paid and treated fairly in the workplace, and more.

Here is what I learned these people have in common: They are facing a challenge in their lives or their businesses that is unfamiliar to them.  They do not know what questions to ask.  In many cases, they do not have a great experience being heard, or feeling like someone has their back. They may have called a few law firms and, instead of finding solutions, been made to feel small, unimportant, or more overwhelmed.

I've learned that it doesn't have to be that way.  We may have seen your problem a hundred times before, but I and my team work hard to remember that it is new to you.  We do not have "big" clients and "small" clients- we have clients, whose issues are all important to us.  Our mission is to give you the best advice, advocate for your interests, help you ask the right questions, and make sure you have the information you need to make the decisions that are best for you or your business.  So that when you come out on the other side of whatever you are facing- and you will- you will have not only a resolution but clarity about how you got there, and how you can avoid that particular problem in the future.

Not sure which way to turn?  Give us a call- we'd really like to help."
