Can I Be Fired for Asking to be Paid Legally?

Asserting your rights under the wage and hour laws is a protected activity under the law.  That means your employer is not allowed to take action against you in retaliation for raising the issue.  This kind of protected activity includes:


  • Complaining internally about overtime or minimum wage violations, or late payment of wages or commissions;
  • Questioning tip sharing policies if you are a tipped employee;
  • Filing a complaint with the Attorney General about wage and hour violations;
  • Requesting a copy of your own personnel and wage records.
