The builder at that time had contracts in place with the property owner to sell individual lots within the subdivision and oversee the construction of homes on these lots.

Key Facts:

Pursuant to the agreement between the Defendants, it was stipulated that the property owner was obligated to transfer the deeds to the individual lots following the execution of purchase and sale agreements between the builder and third-party purchasers, such as Daniel.
However, the property owner refused to transfer the deed to the lot over to the builder following the execution of the P&S and refused to honor the P&S when approached by Daniel.
In an unexpected twist, the property owner claimed to be completely unaware of the P&S or the initial deposit, indicating to Daniel that the lot he had put a deposit on was no longer for sale.
Furthermore, the property owner insisted that Daniel could only purchase a lot in the subdivision if he agreed to pay close to $100,000 more than the agreed-upon purchase price in the P&S.

Our Solution

In response to these disputes, Daniel sought and successfully obtained an order of lis pendens, effectively restricting the title to the property, preventing it from being sold while the legal dispute was ongoing. The property owner attempted to have Daniel's case dismissed, arguing that there was no contractual relationship between himself and Daniel, and denying that the builder had any agency relationship with him. We successfully defeated that motion, then conducted extensive discovery. Shortly before the scheduled trial date, the parties reached a favorable settlement that protected Daniel's interests and rights.
