When Should I Get My Final Paycheck?
If your employment is terminated by your employer (in other words, it is not a voluntary resignation), you are required to be given your final paycheck on the day of termination.
The Supreme Judicial Court has recently clarified that even when a final paycheck is only days or weeks late, it is still a violation of the Wage Act, and still entitles the employee to treble damages if they bring a claim in court. If you resign voluntarily, you are still owed your final wages, but the employer can pay you in the next regularly scheduled payroll rather than on your last day. Your final paycheck should include:
