This is of particular concern when it comes to health care proxies, as an extended family who does not recognize the marriage may seek to intervene if their relative is incapacitated. This requires careful planning and a frank discussion about each spouse's family situation.
If the couple is not married, they are missing out on many protections under the law, but can still ensure their assets pass the way they want, and the people they want serve as health care proxy and power of attorney, with the right estate planning documents.
