Product manufacturers owe consumers a duty to provide safe and non-defective products. Some products are defective because their design makes them unreasonably dangerous. Other products, like pharmaceuticals, have inherent risks that cannot be avoided. In that instance, the manufacturer has a duty to warn the consumer of those risks, and can be liable for the consumer's injuries if it breaches that duty.
In Massachusetts, a defective product is a breach of warranty, which in turn can give rise to a claim under the Massachusetts consumer protection statute, Chapter 93A.
