Attorney Jack Thaler Wage and Hour Cases
The following are some examples of the clients Attorney Thaler has helped to resolve cases arising from the Massachusetts and federal wage and hour laws.
Our client worked for a commercial painting company. He and his co-workers would be be paid by the company for the first 40 hours they worked each week. If they worked over 40 hours in a week, however, they received a separate check from a different, related company for those hours.
The second check paid their regular hourly rate, and did not include the time and a half for overtime required by law.
Jack filed a complaint on behalf of this client, claiming that this was just a scheme to avoid overtime laws. We sought compensation for unpaid overtime going back several years. By engaging in proactive settlement discussions with the employer's attorneys, Jack was able to reach a favorable settlement for the client before either party had to undergo discovery and litigation.
Jack represented another client who was an HVAC technician. His employer paid him on a salary basis and did not pay for overtime. We were able to present evidence that the client's duties were not exempt from overtime, and that he had worked substantial overtime hours.
After discovery and mediation, we were able tor each a favorable settlement for this client as well.
We represented two senior sales representatives whose compensation was largely dependent upon commissions. At the very end of their commission quarter, their employer changed the commission plan in a way that deprived them both of $100,000 or more in commissions they had already earned by the time of the change.
Attorney Thaler worked on this case, and helped discover and marshal the evidence that supported our clients' claims. After discovery and mediation, we were able to reach a favorable settlement for both clients.
Attorney Thaler represented another sales person who was terminated and not paid commissions earned before termination. By promptly filing with the Massachusetts Attorney General and later in court, Jack was able to preserve the client's right to multiple damages under the Wage Act. He was then able to reach a favorable settlement for the client prior to discovery and litigation.
Unlawful Wage Deductions
Attorney Thaler has represented several employees who had significant amounts of money withheld from their paychecks. Some deductions were made during employment, but the largest ones were deducted from the clients' final paychecks.
In each of these cases, Attorney Thaler filed the complaints that preserved the clients' rights, engaged in timely and proactive settlement discussions, and resolved the claims on terms favorable to the clients.
