The following are some examples of the clients Attorney Thaler has helped to resolve cases arising from discrimination in the workplace and in public places.
Disability Discrimination in Public Accommodations
Our client has a young adult son who has autism. The young man was a regular at a public library where he used to go as a child with his parents. He enjoyed using the computers and seeing people, but as a result of his autism had difficult responding appropriately to social cues.
The library director was uncomfortable with the fact that the young man stared at people. He filed a "no trespass" order with the local police, and banned the young man from the library.
Once informed that the young man was autistic, and that the behaviors they were concerned about were simply a manifestation of his disability, the library took no action and did not remove or modify the no trespass order.
We brought suit in the United States District Court for the District of Massachusetts. We claimed violations of the Americans with Disabilities Act ("ADA") as well as state law prohibiting disability discrimination in public places.
After limited discovery and mediation, Attorney Thaler was able to resolve the case. The settlement included agreed conditions under which the young man could use the library, and a payment to the family. It also included the thing which the client had wanted the most, which was an agreement by the library to implement autism awareness training for all library staff.
Disability Discrimination in Employment
An older worker at an insurance company went on leave for a serious illness. When she returned, she was harshly penalized for taking shorter amounts of time to see doctors and continue with her recovery. Shortly after her return she was terminated.
Attorney Thaler began working with this client after she had filed with the Massachusetts Commission Against Discrimination. He helped her and her family understand and assess their claims. He also advocated to the attorneys for the employer to help them understand the strength of her claims. By keeping open lines of communication with the client and with opposing counsel, Attorney Thaler was able to reach a favorable settlement before the parties had to go to mediation.
Race Discrimination in Employment
Attorney Thaler represented an African American woman who was employed by a private contractor in a Massachusetts correctional facility. She was abruptly terminated under questionable circumstances, involving conduct that other white employees engaged in without consequences.
Attorney Thaler helped her assess her situation and her claims, and drafted and filed a complaint in MCAD and then in the Superior Court. By fending off legal challenges by the defendants and actively pushing negotiations, he was able to help her receive a favorable monetary settlement without having to go through full discovery and litigation.
Age Discrimination in Employment
Jack has represented several clients who were over 40 and terminated in favor of younger workers. In each of these cases, he was able to work with the client and the lawyers for the employers to reach favorable and confidential settlements for our clients.
Harassment and Retaliation in Employment
An slnlaw client had reported sexual harassment to her supervisor. She was immediately terminated. Attorney Thaler worked with her to draft and file a complaint.
Attorney Thaler took the case all the way through discovery. He and the slnlaw team reviewed all of the relevant case documents, prepared the client for her deposition, and conducted depositions of the employer. After discovery he was able to negotiate a favorable financial settlement for the client without having to go to trial.
